Federal Judge Chief Judge Royce C. Lamberth recently expressed concern that if he makes a mistake in a detainee case, it could result in the release of a dangerous terrorist. In response Abdal Razak Ali, a detainee of Guantanamo for over seven years, filed a Motion for Recusal on January 29th. Page ten of the motion quotes Judge Lamberth as saying “How confident can I be that if I make the wrong choice . . . he won’t be the one that blows up the . . . Capitol ?” See here for a post by SCOTUSblog, including a link to the motion.
The Department of Justice has not responded but has the option of answering.
